Who Gets The Engagement Ring?

When couples divorce, one issue that often comes up is who is entitled to the engagement ring. Under Florida law, and engagement ring is a conditional gift, conditioned on the marriage taking place. Once the marriage takes place the engagement ring belongs to the recipient. According to the Florida courts, even if the ring is a family heirloom the engagement ring is considered to be the separate, nonmarital asset of the recipient and is not subject to equitable distribution between the parties at the time of the divorce.
